These terms govern access to the ecufundprop.com site and the use of the inquiry form. Acceptance of these terms is a prerequisite for using the service. If you do not agree, we ask you to refrain from using the site.
1. Owner
The site is operated by Ecufundprop S.A.S., a company incorporated under the laws of the Republic of Ecuador in 2019, registered with the Commercial Registry of the Quito Canton (Volume 412, Folio 2087) and supervised by the Superintendency of Companies, Securities and Insurance under file No. 730245.
2. Nature of the program
Ecufundprop offers a private participation program in residential housing projects in Ecuadorian territory. It is NOT a government program, does not constitute a public offering of securities nor a massive collection of money under the Organic Monetary and Financial Code. Participation is subject to individual contracts signed between the parties.
3. Eligibility
Natural persons of legal age may initiate an inquiry, preferably Ecuadorian citizens or permanent residents born between 1960 and 1985. Final eligibility depends on document verification and compliance with anti-money laundering policies (UAFE).
4. Risks
All real estate investment entails risks. These include: construction delays, regulatory changes, price variations and, in the worst case, partial or total loss of the contributed capital. Distributions are periodic but not guaranteed and depend on the project's progress. Past results do not guarantee future results.
5. Use of the site
You agree not to use the site for unlawful purposes, not to introduce malicious software, not to reverse engineer or copy protected content. Ecufundprop may suspend access in case of misuse.
6. Intellectual property
All texts, images, trademarks and graphic identity of ecufundprop.com are the property of Ecufundprop S.A.S. or used under license. Reproduction without written authorization is prohibited.
7. Limitation of liability
Ecufundprop S.A.S. will not be liable for indirect damages, lost profits or loss of opportunity arising from the use of the site. The site is offered 'as is', without guarantees of uninterrupted availability.
8. Governing law and jurisdiction
These terms are governed by Ecuadorian law. Any dispute will be submitted to the competent judges of the Metropolitan District of Quito, with the parties expressly waiving any other jurisdiction.
